Carnival on the occasion of parliamentary elections: Temporary workers demands permanent hiring and adopting decent work and adequate income for decent living
Amidst the carnival of parliamentary elections, in which observers are unable to distinguish between the candidates of the next session except in terms of religion, occupation, sex, and amid signs reflect the league, money, influence and services get lost; the demands of the Egyptian social movement for the release of detainees and the abolition of emergency laws and restrictions on the freedom to form political parties, associations, and ensure the right of association, assembly, and freedom and personal safety and opportunities for decent work and adequate housing and adequate income for decent human living all get lost. All these incidents go amid slogans of the majority of candidates filed, who declare their belonging to the Department and the District without paying attention to the demands that witnessed the struggles and fights by the thousands of Egyptians hoping the renaissance and progress of our country.
Amid this carnival, land center had received many complaints from the temporary workers in state departments, who ask for being appointed, the settlement of their careers and ensure their rights to decent work. For example, there is a complaint of workers with academic qualification- granted pre-service or during the services- at the department of drinking water in Capital Cairo, where their employment situation is not settled, in a violation to the Act of 5 for 2000 and Article 9 of the Annex to the Staff Regulations and discrimination between them and their colleagues whose employment situation were settled.
The workers mentioned that they demanded the settlement of their cases after their appointment many times. But the Chairman of the Board of Directors of drinking water in Capital Cairo rejected the proposal without giving reasons, in violation of the law, and what contradictory within the company that they are hiring new staff hold a Postgraduate qualification in spite of a campaign of higher qualifications of temporary workers the company.
In addition, the company had settled the cases of certain staff of the relatives of influential people while working more than 21 applicants complain of the Centre management of the company ignored their claims.
Although the workers in the department has applied for the North Cairo Court, filed No. 3573, for 2010, asking for their right to settle their job according to qualifications they obtained and to apply the law, but land center has received an absurd response from the head of drinking water in Capital Cairo, in 20/11/2010, testifies he did not know about the incident despite being notified of the principal newspaper contained the requests of staff and demanded to know the names of the complainants to their study. The authors of the workers fear that the company management threatened them with dismissal and redundancy, as long as they continue to demand their rights!!.
The center also received complaint of tens of post officers outside of the cities. They reported that their work, National Authority for mail for more than fifteen years and eagerly awaiting the decisions of the settlement of their status, tenure, although they have the qualifications during the service and before it. The complainants confirm that the failure to settle their cases of depriving them from the incentive, which is estimated two hundred pounds, is paid to their colleagues recruited in cities, though some was appointed one year ago.
They seek equality with their colleagues and respect for the Egyptian constitution and law, which guarantees them the right to settle their situation and proofed.
Land center confirms that all Egyptians are equal and should not be discrimination, including application of the law and the Constitution and international covenants on human rights.
Complainant workers showed apathy when asked to place the necessity of participating in the parliamentary elections for the nomination of members worthy of the protection of the workers' rights and control over the government's performance. They said, mostly, that those who success in the election are businessmen and owners of factories and companies who violate the rights of workers and steal the wealth of the people, and that fraud and poverty are transforming, with no successful candidates who can defend the rights of workers in good jobs.
Land Center demands Directors of the Greater Cairo Water Authority and Chairman of the settlement of cases of e-workers and temporary workers to install two bodies to ensure the rights of workers in the security and decent work.
The Centre calls upon the President and members of the People for the 2010 to compel the government to appoint temporary staff and the settlement of their career interests of the rights of citizens in the safety and decent work.
LCHR asserts that more than three million workers in Egypt are suffering from encroachment on their rights because of not being hired or insured within the organs of government or the private sector; despite labor protests, which increased in 2010, claiming the rights of workers in the work and decent pay.
The centre would like to emphasize the demands of the protest movement on the occasion of Carnival parliamentary elections candidates actually remember that the next parliament to ensure the rights of Egyptian workers will endow them with confidence in the re-election to gain parliamentary immunity and the centre hopes to achieve the following demands to the next course:
1 - allow workers to exercise the right to strike and peaceful assembly and amend the text of Article 198 of Law No. 12 for the lifting of prohibitions on the exercise of this right
2 - amend the Unions Act No. 35, giving the right of workers to form independent unions and multiple them away from the official unions to enable them to defend their legitimate rights to decent work and fair pay.
3 - To force public and private companies to pay social insurance for workers and create a mechanism to ensure the monitoring of the implementation of the competent bodies. And to compel the government not to speculative funds Social Security and not to act in the interest of the lives of millions who have to pay this money from their efforts.
4 - Ensure that workers' wages and benefits are paid under any circumstance, with salaries on time, methods and mechanisms appropriate to ensure the lives of millions of workers.
5 - to stop the policies of arbitrary dismissals and transfers of workers as a prelude to the liquidation of the factories or selling them to the private sector.
6 - The appointment of temporary workers and give them adequate guarantees for a stable and secure work, and ensure the rights of labor other bodies, whether governmental or business sector or private sector.
7 - To stop the intervention of some security agencies, which terrorize the workers and pressuring them to express their demands during the fair pay and incentives, or yo you use the means of protest and strike.
LCHR calls upon the citizens and civil society institutions to choose worthy representatives of the protection of the rights of workers to ensure the rights of Egyptian workers in ensuring the future of a more just and humane, a nation where all citizens enjoy security and freedom
