Communiqué to the General Prosecutor: “By orders of a police officers, Citizen Bashir Ghoneim is abused and arrested of no charges”

 

Tells "Bashir Ghoneim," citizen of a village called Lasfeer country side, Desouk Center, Kafr El-Sheikh Governorate, in his report against persecution and abuse of police Major "Amr Shawki", after an argument between him and the citizen’s son, who is a lawyer. The police Major replied to this argument by making official reports against the citizen and all his family member’s men and women, accusing them of resisting authorities and assaulting a police car, which brought all of them before the prosecutor for questioning in the record number 13137 for 2009. Accordingly the prosecutor decision was releasing all of them for the fabrication of the charges, but the Police Major using his given authority detained them at the police station since 20/7/2009 until 27/7/2009 unduly.
The citizen adds: "During this period, the police major gave orders to his guides to fabricate many official records against me and my sons, reached up to 8 records accusing us of abusing them, and when we were brought to prosecution, we were released without guarantees because of malicious accusations.
The unfortunate thing is that among those who liberated us the records there was a police detective, claiming against us in the administrative record No. 9027 to confirm all of these malicious complaints. The citizen keeps asking in grief, "What have we done for all of this? Does a normal discussion from one of my sons to a police officer who is arresting him summon all of this injustice against us? Is fate and human life still in the hands of police officers alone? Could it be in the twenty-first century, while having all these development within agencies, international institutions and local human rights, it is still left to an individual even if he was a police officer, to use all this power to disqualify an entire family of their rights to security? As the police officer made sure that I am registered now as ‘dangerous criminal to public security’ while I am a farmer who has never been into a police station as accused all through his entire life, fifty eight years now! No complains are registered against me ever before. I have never done any acts in breach of honor, currently I am arrested in Burg Al Arab prison ward No. 22 of 16.
The unfortunate thing also as emphasized in the citizen's complaint, that these pressures and accusations made by the officer to force the citizen’s sons who are lawyers, to condones abusive practices and abuse from the officers side against local citizens, in additional to violations of law which they declared through their accusation of fraud against the officer in an official report to the police mainly because of the officers illegal trade in monuments. Mainly the officer is exercising such pressure on citizen’s sons to force them not to provide the documents they are holding under the hands against the police major which prove him guilty. The Police major also threatened the citizen and his sons that if these documents were ever presented, it will be the father’s fate to die in prison, and no one will question him about it.
Land center stresses on the need to regulate the use of the emergency law before the ministry of interior affaires, because of the increasing cases of arbitrary arrest of citizens committed common crimes organized by the Egyptian Penal Code, but the ministry of interior affaires misused emergency powers against the citizens, they make decisions of arrest without censorship of respect for the provisions of the Constitution and international covenants of human rights.
The Land Center calls all members of the People's Assembly, Shura Council and the Egyptian political parties to stop the application of the emergency law, which is not required for our state of the country to continue using it for more than twenty-five years, while there are no justifications or disasters threatening security and stability of the country.
As the center filling complaint of the citizen HE Minister of Interior and HE Minister of Justice and the Attorney General to investigate these incidents and the prosecution of the police officer concerned, also release the citizen and stop the threats to his family members to ensure application of both their constitutional and legal rights, allowing them to live freely and safely in our protected country Egypt.
The Center calls all civil society organizations in West governorate, members of the People's Councils and local communities to support the demands of the citizen to liberty and security and to stop the threats against his family.
