Report to the President of the Republic of Egypt and the deputy general The necessity of financial and managerial supervision on the schools of Moslem youth in Sharkeya governorate Will the teachers explode because of a network of benfinciaries and corrupt individuals who hinder the laws and seize their financial rights?

Dozens of teachers from the school of the society of Moslem youth in Sharkeya have filed complaints to Al Ard center to stop the oppression and the violation of their rights practiced by the owner of the schools. According to the complaints he violates and manipulates the law, and conspires with the officials of the regional education directory and the private education committees in the governorate.
Teachers have filed complaints to every concerned directory, and none of which had responded to their requests which compelled them to go on strike in the school in 2007, and again in 2009.
Some governmental reports have proven that the owner of the school had violated laws and instructions for which the regulations have set penalties that can be as severe as jail sentence.
These reports have also mentioned that the school owner did not provide bonuses for teachers as stated by law, same as exam rewards. In addition to that he did not abide with changing the job title, he did not calibrate the teachers' qualifications, and he did not pay insurance rates set by the authority of social insurance of which the values are up to two million Egyptian pounds. In addition he manipulated official documents to seize quotas, governmental payments on the activities of the school. He refused to give female teachers fully paid maternity leaves; neither did he allow an hour for lactating mother. These reports have also proved dozens of excessive sanctions in violation to schools' regulations and the labor law, as he had fired several teachers every year.
öAlthough the several reports since 2007 until now are proving all the above mentioned violations, and the complaints have been investigated, this only resulted in continuing those violations, and their increase, resulting in turn in worsening the situation and the work environment at school. The school owner carries on his violations to the rights of the teachers and the students, so what are they to do? Is there no responsibility towards the employees' rights?
And how can the teachers carry out teaching boys and girls while they are forced to endure the oppression.
Is this the a healthy climate to provide by the ministry of education and the owners of private schools to raise and educate our children and youth to be capable of facing new challenges in the future? Who will carry out this mandate if the teachers have to endure continuous oppression without protection?
For our part, we presented the demands and complaints from the teachers. We urged the President to issue a decision to put the schools of Muslim youth under the administrative and financial supervision of the Ministry of Education. This is meant to stop the tyranny and arbitrariness of the management and its president, and also to ensure the rights of the students and teachers and the quality of education in these schools.
It should be noted that the administration of the schools mentioned are in complete disregard of the reports of the Education directory, defy the law, in such a way that deepens corruption and nepotism. The teachers of the muslim youth schools have gone on strike several times as a result of the oppression, injustice and negligence they have to suffer. This resulted in an increase in the might of the school owner. After the teachers' stand in 2007, the directory financial and managerial orientation of Sharkeya governorate prepared and submitted a report to the head of the governorate and the Minister of Education and all concerned agencies in Egypt. They stressed in their report the presence of numerous violations to the laws.
The report demanded from the governor and the head of the Directory of Education to eliminate the anomalies and applying the law. The families of the students were happy with the new decisions and the new report of the protesting Committee, which proved the instructions on the exchange of sound financial benefits of rewarding employees for examinations without taking into account the 2005/2006 year the minimum of ten days and only added regardless days of the reward system, 50% of salary based on the number of 20 without taking into account the minimum of the last ten days added to the reward.
He also defied the law in the collection of the 20% (plus social) disbursed to the former school employees for the months of July and August and deducted on the payroll of employees of the month of July and August 2005 in violation of instructions as the allowance has been included within the expenses of students for a full year and that the report of the protest Committee - from the ministry refers to the cessation of an incentive payment of 25% of assessments for school employees, similar to their colleagues in the formal education schools month taking effect from July 2009 until 31/3/2007 with supporting document from the law, where the payments to the employees, and the payment stopped at a total cost of 112,392.63 pounds.
The committee recommended the need to address the shortcomings and the removal of anomalies and prepared a report to the governor and the minister. Starting from the period between 16/4/2007 until 3/6/2009 the school administration has committed retaliatory actions against the school teachers and violated their rights and practiced more pressure on them that they could not tolerate that anymore. Thus the teachers were forced to protest once more. As a result a committee from the directory of financial and administrative in the Education directorate of Sharkeya governorate, confirmed the presence of injustice and violation of the laws on the staff of the schools of Muslim youth, and issued a report which contained twelve proven violations by the school administration, threatening the lives of students and the rights of teachers also noted a breach of the report of the Committee and was the most prominent of these irregularities the following:
- The schools of muslim youth represented by president of the society of muslim youth has violated the rules to be applied in construction or expansion, where the school constructed a annex No. 4-1 without the commitment of architectural graphics in addition to the establishment of an annex on the ground floor room next to the electric transformer chamber, the poor condition of toilets and the presence of leakage in the ceilings, exposed electric wires in the classrooms and there will be no maintenance, putting the lives of students and teachers in danger in addition to:
Withdrawing a percentage of 15% which represents the profits of the school owner, which amounts to 527915.20 whereas the amount that should be received until 31/8/2008 is 51765.25
Continued non payment of the 25% incentive decided for the employees in private schools, according to the decree of the prime minister, like their counterparts in formal schools.
The sanctions to which the employees are subjected do not conform with the articles of the ministerial decree number 306 for the year 1993 in addition to the presence of two regulations in the schools, one of which concerns the sanctions, and the other concerns the flow of work, and both of them haven’t been validated by the education directory in addition to their violation to the labour law, especially in the exaggeration of penalties and deduction from salaries and rewards.

He did not pay the employees the social raise for the months of July and
Withdrawal of sums of money from the school account for the benefit of the society under the account of activity, with a ratio of 15% which violates the law Salaries, incentives and rewards for exams, for the employees in the information system were spent from the activities' account and not from the salaries account which is against the law, and breaches the decisions and regulations.
Renting the school canteen, which is one of the school utilities, which is against the law 306 of 1993.
Not applying the regulations of articles of the law number 79 for the year 1975, and the private law of the Egyptian child no. 12 for the year 1996 and the unified labor law number 13 for the year 2003, especially regarding maternity leaves, and lactation hours, and dozens of examples mentioned in the report.
Not paying the incentive of distinction for the deserving beneficiaries from the school employees which are considered a violation to the regulation of private education and the report has highlighted some examples.
Hiring Mohamed Tharwat AÇmed, Hossam Sayed Ateya, Ahmed Abdel Hafiz, and Saber el sayed, starting from 4/10/2008 without issuing insurance form, and without contracts until the date of the report, without including their names in the form no. 3 for private education, in addition to hiring unqualified teachers and not abiding with the legal rules or the regulations of transport, training and insurance.
Transferring some teachers to administrative jobs to deprive them from the payments for teachers inspite of the fact that some of them worked as a teacher for over ten years, in addition to anomalies in operating laboratories and computer.
Not being committed to implementing the instructions issued from the license providing party, thus violating the decision of the committee issued in 16/8/2008 which holds the necessity of paying the social raise, with a percentage of 10% and 20% for the months of Jul and August 2005-2006 except that they did not abide by the decision of the committee.
The report recommended adopting the necessary measures after submitting the matter to the committee of private education affairs in the education directorate of Sharkeya, and advising the financial and administrative orientation department in Zagazig education directorate to eliminate all the anomalies, and in case of non compliance, the matter will be raised to the directory of private education to put the schools under financial and administrative supervision.
Sadly, the report of the directory of financial and administrative orientation issued in 10/6/2009 and after recounting the above mentioned 12 anomalies, has showed the point of view of the schools owner, who postponed the matter until writing reports about it, or consulting the ministry or his saying: "the elimination of anomalies is ongoing" in spite of the fact that these anomalies have started since 2007 which denotes conspiracy with governmental protection and monitoring agencies in the governorate.
As for the committee of private education affairs which was held on the 15/6/2009, it has recounted the anomalies, and justified for the school owner to come up with them, and emphasized contacting the financial and administrative orientation directory to take his opinion and pointed ironically at the protest of employees and decided to punish them, whereas the 25 teachers who did not take part in the protest were awarded 1000 Egyptian pounds, out of three hundred teachers.
Teachers have emphasized, in response to the two issued reports from the committee of private education, and the directory of financial and administrative orientation in the governorate that it was supposed to remove the anomalies especially those related to the buildings, and paying back the money that the school owner has taken unrightfully, and punishing him for violating the law of private education 306 of 1993 and the labor law number 12 for the year 2003, and the child law. The teachers want to be equal to their counterparts in public schools, especially that no body has the right to deprive the employees from a monetary advantage that has been paid to them regularly according the law regarding leaves and sanctions, which the two committees have postponed looking at. It was imperative to remove the sanctions on the teachers without iany incrimination, or investigations and issuing a legal document, and paying 25% of the examination reaward.
That in addition to paying social raise for the months of July and August 2006 and 2007 and paying back the amounts deducted from the female employees regarding maternity leaves, which have been deduction in violation to the labor law, which states that maternity leaves are fully paid, and that caring for babies inside the school is a protection to the rights of the employees' children, and paying the late payment for teaching profession.
As a result of the negligence showed by both committees concerning the removal of anomalies, and conspiring with the school owner, the latter took vindictive actions towards some of them, especially the following.

Ahmed Abd el Hafiz, Hossam Samir, Saber el Sayed, Mohamed Tharwat, who have been lately terminated.
4. Termination of Mr. Ehab Mohamed in retaliation to his participatin in the latest protest.
5. Mrs. Mushira Hassan and Mrs Yasmin Ali
Deduction of the 25% examination reward, in addition to oppression and mistreatment recenty.
Sadly, inspite of the proven anomalies, that were confirmed by the directory of financial orientation in more than one communication and report, and also confirmed by the general directory for private education in the ministry of education in response to the employees' complaints, and decided the necessity of eliminating the anomalies, especially paying the belated rewards to employees.
All that didn’t stop the school owner from carrying on with his tyranny and illegal actions, he continued implementing his own policy afer all these reports of protest and complaints, the thing that compelled the teachers to submit the matter to Mr. El Mandooh, the chief of the committee o private education in the parliament and filed similar complaints to the head of the society of muslim youth in cairo, and filing other complaints to all the agencies, including insurance and the relevant ministries, even the national councils and the office of Mrs. Suzanne Mubarac, but there was no action taken by any of the authorities.
This has compelled us, in Al Ard center to raise the complaint of the teachers to the President, to issue his decisions to put the schools of Moslem youth in Zagazig to financial and administrative supervision of the ministry of education, in addition to punishing the school owner and the conspiring employees in the different governmental directories who did not commit to removing the anomalies during the past years in spite of the governmental reports confirming them.
The center is also requesting from the members of the parliament, especially the education committees in both councils to eliminate the violation committed by the owner of the above mentioned school, and punishing the violators, and those who conspire with him against the rights of the pupils and the teachers.
In addition the center raises the complaints of the teachers to the general prosecutor, to investigate these anomalies and taking the legal procedures to punish the violators of law, and do the necessary actions to put the schools under the supervision of the ministry of education.
It also requests from the institutions of the urban society to collaborate with the teachers of the mentioned schools, and protect their rights to decent work, and provide a healthy environment for the education of our children and guarantee their rights to good quality education.
