Right to Organization

The right to organization gives all citizens who work in different fields the right to establish organizations, associations, unions … etc or join them freely and without any discrimination. This right guarantees a number of freedoms, like:
Syndicates: professional syndicates and labor syndicates.
Political parties that consist of a group of people who agree on a certain program that includes a number of demands and goals that express their interests.
Peaceful gatherings and demonstrations organized by citizens to express their opinions and feelings without disturbing the peace.
National associations that are organized by the associations' law no. 48 for the year 2002. This law is full of binds against people's right to establish independent and democratic associations.
Right to organization in international covenants is guaranteed by article no. 22 of the international covenant related to civil and political rights. Right to organization in the Egyptian constitution is guaranteed by the following articles "5, 54, 55, and 56"
There are many legislations and laws that form an obstacle against the right to organization: A. Freedom of syndicates:
Professional syndicates are organized by the unified professional syndicate law no. 100/1993 amended by law no. 5/1995. This law includes some binds in its following articles "2, 3, 5, 6, 6 repeated, 8"
syndicates are organized by law no. 35/1976 amended by law no. 1/1980. This law includes some binds in its following articles "1, 41, 61, 63, 64, 65, 70"
B. Political parties are organized by law no. 40/1977 and its amendments. This law includes some binds in its following articles "4, 7, 8, 17"
C. Peaceful gathering is organized by law no. 10/1914 and law no. 14/1993.

Law no. 14/1993 includes some binds in its following articles "2, 3, 4, 7"
D. Establishing associations is organized by the national associations' law no. 48/2002. This law includes some binds in its following articles "11, 42"
E. The penal law on the right to organization includes binds in its articles "86, 98"
To reinforce the right to organization, the state must revise the legislative structure related to this right. Put a specific meaning for the words general system, public safety and national security in order to criminalize who violates them. CSOs should form committees that can work with associations, parties and syndicates to remove all binds and obstacles against practicing this right so that people could live in a democratic, safe
