Workers right in labor syndicates to choose their representatives without any authority interference
The third article of agreement no. 86 asserts that workers have complete freedom in choosing their representatives in labor syndicates without any governmental interference that can limit or hinder this right. As the call for nomination, forming the observation committees, organizing the voting process and announcing the results must be done without the interference of the authorities in any way.
For example: some legislations specify that the administrational authorities must be informed about the names of the candidates with a suitable time period before the elections start, so that it could object on the participation of certain candidates or even exclude them. Also any candidate must have written authorization from the administrational authorities in order to nominate himself in the labor elections, which contradicts with the principle of free syndicates and with workers right to freely choose their syndicate representatives. This also includes any legislation that allows the administrational authorities the right to interfere and observe any of the labor syndicate electoral stages. As if there has to be an observation body, then it must be the judiciary authority.
The conditions that all candidates have to apply to, must be specified according to the syndicate internal panel, to guarantee that these conditions satisfy the syndicate members. As there is a number of conditions and stipulations specified by some legislations that candidates must apply, but these stipulations contradicts with the principle of free syndicates, because these stipulations are related to the professions, political opinions, number of nominations or criminal convictions of the candidates, which prevent them from being leaders in the labor syndicates or even joining these syndicates.
Giving the workers their right to freely elect their syndicate leaders will lead to improving their livelihood conditions and guarantee them a better and fairer future.
